However, in response to China’s recent announcement that it will implement the new regulations of the China Coast Guard Law passed in 2021, allowing coast guard ships to fire on foreign ships in Chinese waters, including the South China Sea that has sovereignty disputes with the Philippines, Vietnam and other countries, the Philippines accused China is provocative and claims that if it fires on foreign ships, it will not only violate the United Nations Convention on the Law of the Sea (UNCLOS), but also violate the United Nations Charter. All countries have the responsibility to avoid the use of force, especially when illegally claiming maritime sovereignty.
Amid the months-long territorial dispute, foreign suspects suspected of intruding into China's sovereign territorial waters or waters can be detained for 30 to 60 days without trial, according to Beijing's new Administrative Law Enforcement Procedure Regulations for Coast Guard Agencies, which took effect on June 15. , causing the Philippines to protest, saying that this action had no legal basis, and would resort to the International Tribunal on the Law of the Sea, Itlos, to fight back. President Marcos also takes a tough stance and threatens to activate the US-Philippines Mutual Defense Treaty.
