There is no precedent or law as such other than humanitarian conditions, that would stop us from repatriating refugees back to their countries.
United Nations relevant laws clearly state that:
For the millions of people forced to flee, returning home concludes an often traumatic time in exile. It may happen months, years, or even decades after they left.
When it is safe to do so, UNHCR, the UN Refugee Agency, facilitates refugees and other forcibly displaced people to return home. it coordinates large-scale and individual repatriations and work to ensure any returns are voluntary, safe and dignified.
Refugees and internally displaced people can only return home in safety once the root causes for their displacement have been addressed and lasting peace is achieved.
Now, the “voluntary“ part is important.
That is why at border crossings now; Turkish Authorities are getting signed consensual departure declarations from all departees to Syria.
Coerced repatriation is not within UN charter; and is illegal for refugees. But it is legal for migrants.
So when the country they ran away from due to threat of persecution is no longer dangerous to return to, then they become outright migrants. And should logically be legal to forcibly return them.
