Hardly a mystery. India can't unilaterally alter the LoC without inviting international condemnation and being seen as an aggressor. But despite this, Pakistan has lost land in Kashmir. The undemarcated Siachen Glacier was captured by India. Turtuk and some surrounding areas were captured in Baltistan. Kargil was captured as well. When Pakistan signed the Shimla Agreement - India kept these captured territories which were erstwhile under Pakistan. So this wasn't a unilateral change - it was agreed bilaterally that the LoC changed - in India's favor.

The Siachen Glacier wasn't occupied by any force for a capture as such. Yes it was occupied by India first.

The Siachen Glacier wasn't occupied by any force for you to capture. Yes it was occupied by India first.
That's correct. Perhaps my statement was ambiguous. In Siachen, there was no LoC marked so the question of violating the LoC did not arise. It was considered too cold and too frigid for either side to occupy. That was until Pakistan started allowing some foreign tourists access to it.

Which resulted in Pakistan launching Operation Ababil to capture Siachen and India launched Operation Meghdoot with the same objective. India achieved it while Pakistan didn't. But LoC wasn't violated then.

Our unpreparedness at The British House of Commons debate

There is a talk of the town in Azad Kashmir and in Pakistan that the world does not talk about Kashmir because India has a broad spread of market of interests to offer to various countries of the world. It may be so. But it is not so in real terms. We just want to sit back and take refuge behind this self-serving argument.

One can dismiss this fragile argument by the fact that a debate took place in the House of Commons in the British Parliament on 13 January on the “political situation in Kashmir”. The merits of this debate could be queried on the basis of statements made by around twelve Members of parliament which included the Chair and a Minister.

Our lack of input was floating on the surface of the debate. No member addressed the Indian administered Jammu and Kashmir as “Indian Occupied”, while as Barry Gardiner MP from (Brent North) (Lab) referred to Azad Kashmir as “Pakistan-occupied Kashmir” and more so called it “a satrapy”. He quoted Delhi based The South Asia Terrorism Portal and said “that of the 42 identified terrorist training camps located in Pakistan, 21 were located in Kashmir and Gilgit-Baltistan.”No Member of Parliament seemingly on our side, was able to counter this allegation with a reference from the two UN Reports on Kashmir or from a myriad number of JKCHR documents released by the UN Secretary General as UN GA Documents on Kashmir.

Three members of parliament Sarah Owen (Luton North) (Lab), Naz Shah (Bradford West) (Lab) and Paul Bristow (Peterborough) (Con) used one each time the word “self-determination” in their statements. Dr. Ghulam Nabi Fai the Secretary General, of Washington-based World Kashmir Awareness Forum has rightly said that “Self- determination is a principle that has been developed in philosophic thought and practice for the last several hundred years. It is an idea that has caused people throughout the world to rise up and shed the chains of oppressive governments at great risk.” If we dither even after the Indian action of 5 August 2019 in remaining loyal to our core issue of self-determination, we shall be rightly blamed for giving “all to India on a silver platter”.

We need to educate ourselves and our friends at home and abroad that there is a need to challenge India on her statement made at the 533rd Meeting of Security Council
There are other important areas of concern in regard to the preparedness and quality of the debate. It would not be helpful to identify those concerns here in this piece. There was a debate and India could not run away from it. Credit goes to Sarah Owen MP (Luton North) (Lab) for introducing the debate. The only irritation for India would have been the number of speakers and the three time reference to self-determination. If one compares the content and quality of all other ten members with the content and quality of remarks made by Barry Gardiner MP on Azad Kashmir, we do seem to have performed very poorly.

There are a number of reasons for this. The first and foremost is our non-seriousness in managing the case. It has not been managed as required under the Constitution Act 1970 and Act 1974 or as required under UNCIP Resolution. For example we have an inter-mediate (10+) in Azad Kashmir who heads the Kashmir Liberation Cell as its Director General. It is obvious that dividends of such a careless appointment could not be different to what Barry Gardiner MP from (Brent North) (Lab) has said about Azad Kashmir as “Pakistan-occupied Kashmir”.

The second categorydoes not have the ability to work on the issues involved in the Kashmir case. Some even would not be able to spell the right of self-determination correctly. Those who support them in any manner in Azad Kashmir or in Pakistan in fact sin against the people and habitat of Kashmir. India would like to have many of these sinners.

We are allowing India time and opportunity to wear us out and defeat us on our own turf. India tested our alertness in 2004. It put up aDelhi-based NGO ‘We the Citizens’ and later a few more petitions were filed in the Supreme Court of India seeking to scrap the provisions ofArticle 35A. This Article was added to the Constitution by a 1954 Presidential Order. It accords special rights and privileges to the permanent residents of Jammu and Kashmir and denies property rights, jobs, voting rights and scholarships to non-residents of the state. Neither the Government of Srinagar nor the Kashmiri leaders over there, nor the Government of Muzaffarabador the Kashmiri leaders here or the Government of Pakistan raised an eyebrow against the sinister move.

The matter is still pending in the Supreme Court of India and it does not have the courage to advise against a protection available to the People of Jammu and Kashmir as State Subjects for the last 94 years from 20 April 1927. On 2 August 2018members of the Kashmiri Pandit and Sikh communities joined other groups from the Joint Resistance Leadership (JRL)in protest against the petition filed in the Supreme Court and to defend Article 35A. All expressed utmost shock and surprise that the Indian Supreme Court admitted the petition challenging Article 35A, as all earlier such petitions had been rejected or rendered invalid by the court.

Government of Indian has lied in passing its notification of 28 February 2019. It states that “The Union Cabinet has approved the proposal of Jammu and Kashmir Government regarding amendment to the Constitution (Application to Jammu and Kashmir) order, 1954 by way of the Constitution (Application to Jammu and Kashmir) Amendment Order 2019”. The Assembly was dissolved on 21 November 2018 and there was no elected Government in place in February 2019. The administration was run directly from Delhi by an appointee of the President of India. We failed to move into an action from 2018 until February 2019 and through to 5 August 2019.

We should have pulled down the heavens and roof of the United Nations, alerted our friends all over the world, pointing out that the notification on 35A was a serious violation of UN Resolutions on Kashmir, a violation of the agreement between Government of India with the people of Kashmir and a violation of the agreements between India and Pakistan. No single Member of Parliament during the debate on 13 January 2021 pointed out that it was a breach of the assurance given by Prime Minister of India to the Prime Minister of Britain on 26 October 1947.

The flaws embedded in our work culture could not be described here. Except that if we do not correct ourselves, we may have a series of disappointments coming our way. It is never too late to defend the right of self-determination and UN jurisprudence on Kashmir. We need to educate ourselves and our friends at home and abroad that there is a need to challenge India on her statement made at the 533rd Meeting of Security Council held on 01 March 1951, stating that“There is a tendency in certain quarters to assume that this is just a dispute between India and Pakistan, and that the views of the lawful government of Kashmir need not be considered. This is a mistaken assumption. As I have already said, the authority of the Government of India over the Government of Kashmir is limited to certain subjects; outside that sphere, it can only advise and cannot impose any decision.” India needs to be pulled out of her Wombat hole and duly reprimanded.

AJK President Launches Legal Think-tank; Calls For Effective Law-fare For Kashmiri's Rights

ISLAMABAD: (APP - UrduPoint / Pakistan Point News - 20th Jan, 2021 ) :Sardar Masood Khan, President, Azad Jammu and Kashmir (AJK), on Tuesday inaugurated a legal think tank at Millennium University College (TMUC) in the federal capital to promote a comprehensive understanding of legal issues among all stakeholders and to bring forward actionable recommendations on international law, foreign policy and national security challenges of Pakistan.

Addressing the inauguration ceremony organized by Centre for Law and National Security (CLNS) at Millennium University College, he said that the multilateral judicial process is complex and therefore it is important that the whole nation must adopt a uniform legal approach to resolving and presenting the Kashmir issue.

According to a release of AJK President office, President Masood said, "We have a vacuum in law-fare in relation to Kashmir and the academic discourses by think-tanks like CLNS can fill this void".

The event was also addressed by Special Assistant to the Prime Minister and National Security Advisor, Dr Moeed Yusuf, Parliamentary Secretary Ministry of Foreign Affairs Andleeb Abbas, Former Director-General, NDU Maj Gen (Retd.) Muhammad Samriz Salik, Honorary Chairman, Legal Forum for Oppressed Voices for Kashmir Justice (Retd.) Ali Nawaz Chowhan. Former Federal Minister for Law, Ahmer Bilal Soofi and CEO Roots Millennium school and Chairman Advisory board CLNS, Chaudhry Faisal Mushtaq.

President Masood proposed that the government should invite jurists from all over Pakistan to present proposals on the Kashmir issue. He added that the proposals have to be then presented to the jurists and legal experts of the world. We must synergise our efforts and this can achieve fruition only if we have a strong political momentum overcoming the inertia.

Tracing the origin of the Kashmir issue, Masood Khan said that the people of Kashmir even before the creation of Pakistan vowed to join Pakistan on the basis of a natural bond and relationship between Kashmir and Pakistan. He said India after illegally occupying a major part of the State of Jammu and Kashmir practised "occupational constitutionalism" by falsely claiming Kashmir a part of India.

The AJK President said that we should have a strong conviction that the entire territory of Jammu and Kashmir belongs to Pakistan. He added that India has been harping on the falsehood of Jammu and Kashmir being an integral part of India. "We are not fighting for a distant land. These are our people", he maintained.

Highlighting the illegal actions taken by India in IIOJK, he said that the present BJP-RSS government in India illegally bifurcated the disputed State and made it a part of the Indian federation. Besides this, India has also issued a fake map in which AJK and Gilgit-Baltistan were shown as a part of India.

He said that the agenda of the BJP-RSS regime is driven by hatred, exclusionism and majoritarianism. "It is because of the Indian government's Hindutva policy that Kashmir is the biggest hotspot for Islamophobia in the world. People of Kashmir are being punished simply because they are Muslims. Kashmir is also the biggest terrorist hotspot in the world as India forces are committing state terrorism against innocent Kashmiris", he said.

"The entire nation, as one body, must support the cause of Kashmir. The whole population must come out to the streets and squares in a solidarity with the Kashmirs", he said.

The day was observed near Line of Control in Azad Kashmir under the aegis of Pasban-e-Hurriyat Jammu and Kashmir. Hundreds of people carrying black flags and wearing black ribbons participated in the rally held at Chakoti, Muzaffarabad.

Effigies of Indian Prime Minister Narendra Modi, Defense Minister Rajnath Singh, Indian Home Minister Amit Shah, Indian Army Chief General Manoj Makand Nirvana and Bipin Rawat were set on flames. Protesters burnt tires to record their protest against Indian state repression in occupied Jammu and Kashmir.

While addressing the protesters, Chairman of Pasban-e-Hurriyat Jammu and Kashmir Uzair Ahmad Ghazali said that India was not a democratic country but a system of terror, oppression and barbarism. Other speakers said that the Indian forces were destroying peace by shelling unarmed civilians on the ceasefire line. Among those who addressed the rally included Shaukat Javed Mir, Shakirul Islam, Javed Ahmed Mughal, Azmat Hayat Kashmiri, Peerzada Syed Sultan, Raja Qasid, Zahid ul Qamar Khan, Javed Ahmed Mughal, Shabbir Ahmed Abbasi, Chaudhry Muhammad Riaz, Tahir Muhammadi, Abrar Abbasi and Muhammad Aimal Farzam.

Meanwhile, a protest demonstration was taken out under the aegis of Kashmir Liberation Cell in Muzaffarabad. Participants of the rally holding placards and banners inscribed with anti-India and pro-freedom slogans marched from Secretariat Complex towards Burhan Muzaffarwani Chowk.

Addressing the rally, the speakers invited the attention of the international community and United Nations towards the continued, unlawful, and forced Indian occupation of Jammu & Kashmir for the last seven decades.

On the other hand, an anti-India protest demonstration was organized by Tehreek-e-Istiqlal Jammu and Kashmir Youth Wing at Garhi Dupatta in Muzaffarabad on the occasion of Indian Republic Day. It was led by Tehreek-e-Istiqlal Youth Wing Chairman Tanveer Khan Durrani and participated among others by Pakistan Tehreek-e-Insaf leader Nasir Ali Haidry, former Administrator Town Committee Garhi Dupatta Rashid Naqvi, Yasir Lodhi, Aurangzeb Tantrey, Riaz Awan, Khayyam Munir Awan, Faizullah Durrani, Syed Zubair Shah, Shabbir Awan, Safeer Koshi, Arshad Awan, and a large number of people.

The demonstrators shout slogans in favor of Pakistan and against India. Addressing the protesters, the speakers said India is a rogue country, which has no right to claim itself a democracy. They said that India had no right to celebrate its Republic Day as its troops were perpetrating grave human rights violation in IIOJK.

UN Resolutions on Kashmir are not history–We have a case without them as well

Dr Syed Nazir Gilani

Even today after 73 years, people of Jammu and Kashmir, their leaderships, various disciplines in charge in Azad Kashmir and Pakistan and the people who remained in power in Azad Kashmir and in Pakistan are not clear about the constituent nature of the Kashmir Case. The interpretation is based either on an ignorance or on an instinct to play to the Indian gallery.

India has continued to keep the course until it decided to change her horses and occupied part of Kashmir on 5 August 2019. India floated the ideas thatthe case has been considered under Chapter VI of the Charter and bloated the egos of our leaders and writers to propose an out of box solution. Some made a gross error of calling UN Resolutions as history.

India succeeded to force Pakistan off the UN mechanism on Kashmir for 32 years from 1251st session of UN Security Council held on 5 November 1965 till 15 September 1996. It was on 22 August 1996 that Kashmir was hit by rule 11 of rules of procedure of the Security Council (S/1996/603).

India forced Pakistan to disturb Kashmir as a core issue and make it an include into 8 other items outstanding with India. It became an issue out of many other issues in 1997. On the contrary India had conceded at the 230th meeting of the UN Security Council held on 20 January 1948 that Kashmir was a core issue. Indian representative Mr. Gopalaswami Ayyangar said “We hope to be able to convince the Security Council that once we have dealt with· the Kashmir question, there will probably not be anything of substance which will divide India and Pakistan to the extent of endangering international peace and security”.

Government of Azad Kashmir in its constitution Act 1974 and the Hurriyat Conference in Indian occupied Kashmir in its constitution adopted on 31 July 1993, inscribe their faith in UN Resolutions on Kashmir. Pakistan has tied itself to these two documents and to article 257 of the Constitution of Pakistan. Unfortunately we dithered in prosecuting the jurisprudence of UN Resolutions on Kashmir.

The school of opinion that has been calling UN Resolutions on Kashmir a history and intentionally or unintentionally have played to the Indian gallery need to know that, they are wrong
Dr. Syed Ghulam Nabi Fai Secretary General of World Kashmir Awareness Forum has said “These are not resolutions in the routine sense of the term. Their provisions were negotiated in detail by the UN Commission with India and Pakistan and it was only after the consent of both Governments was explicitly obtained that they were endorsed by the Security Council. They thus constitute a binding and solemn international agreement about the settlement of the Kashmir dispute.” Dr. Fai’s view corresponds with the position taken by Britain at the UN Security Council. UK representative Sir Gladwyn Jebb said at the 606th meeting of the UN Security Council held on 6 November 1952 that, “The ultimate objective of a fair and impartial plebiscite under the auspices of the United Nations ….has been written into solemn agreements by the two Governments and endorsed by this Security Council. These agreements have been affirmed and reaffirmed by the two governments many times.”

The schools of opinion that misinterpret Chapter VI and volunteer to call UN SC Resolutions as history are the self-styled experts on Kashmir and even some Think Tanks based in Islamabad have been duped by their counterpart Think Tanks in Delhi, to spell wrong on Kashmir and start a harmful stutter.India has used this stutter to her advantage.

Kashmiri leadership spoke at the UN SC in February 1948 and came into contact with UNCIP in September 1948. Otherwise, Kashmir has remained a free for all and with no holds barred gainful interest. We are seeing individuals from Diaspora accredited as leaders by Islamabad and discussing Kashmir in the Azad Kashmir newspapers. These people are taxi drivers or from an unemployed lot who have never held a position of service all their life in Britain. They could be called good escorts and smart operators of group political tourism.

During the period from 1990 to date non-Kashmiris have also floated interested groups on Kashmir and these groups have continued to enjoy the hospitality of Indian Government and in some cases hospitality of the Government of Pakistan as well. If Islamabad and Muzaffarabad continue with this make believe jig even after 5 August 2019, it is a recipe for disaster.

The school of opinion that has been calling UN Resolutions on Kashmir a history and intentionally or unintentionally have played to the Indian gallery need to know that, they are wrong. Whether we had UN Resolutions or not we have the following jurisprudence of the case:

Prime Minister of India Jawaharlal Nehru has assured the British Prime Minister on 26 October 1947, before despatching Indian army to the State on 27 October 1947, that, “I should like to make it clear that the question of aiding Kashmir in this emergency is not designed in any way to influence the State to accede to India. Our view which we have repeatedly made public is that the question of accession in any disputed territory or State must be decided in accordance with wishes of people and we adhere to this view. It is quite clear, however, that no free expression of will of people of Kashmir is possible if external aggression succeeds in imperilling integrity of its territory”.

On 27 October 1947, Governor General of India Lord Mountbatten has assured the Government of Jammu and Kashmir that, “…the question of accession should be decided in accordance with the wishes of the people of State, it is my Government’s wish that as soon as law and order have been restored in Kashmir and her soil cleared of the invader the question of the State’s accession should be settled by a reference to the people”.

On 31 October 1947 Prime Minister of India in his telegram to Prime Minister of Pakistan has assured that, “Our assurance that we shall withdraw our troops from Kashmir as soon as peace and order are restored and leave the decision regarding the future of this State to the people of the State is not merely a pledge to your Government but also to the people of Kashmir and to the world”. (Para 6 of the telegram dated 31 October 1947).

The representative of India has laid down his case at the 227th meeting of the UN Security Council and has made three prayers that, “The question of the future status of Kashmir vis-a-vis her neighbours and the world at large, and a further question, namely, whether she should withdraw from her accession to India, and either accede to Pakistan or remain independent, with a right to claim admission as a Member of the United Nations- all this we have recognized to be a matter for unfettered decision by the people of Kashmir, after normal life is restored to them.” This submission made by India was reiterated by China at the 765th meeting of the Security Council held on 24 January 1957.

The people of Jammu and Kashmir have a strong case of self-determination, even if there would have been no UN Security Council Resolutions. Britain had offered a reference to International Court of Justice on 22 November 1947, months before India made a reference to UN Security Council. It is our duty to understand our case and prosecute its jurisprudence and merit accordingly. We are still walking off the track and unfortunately our attempts to engage our people into make believe optics are of no consequence.

We have accrued a criminal liability for introducing a rag a tag militancy (which surrendered) and a political alliance which abandoned its constitution and allowed Government of India, a lease of life, denied to her all along for 42 years from 1948 to 1990. The militants and the politicians changed their horses mid-stream and majority of them have turned into successful businessmen in India and in Pakistan. Some have found Kashmir as a ‘gainful’ item and are engaged in political tourism in the name of Kashmir.

AJK’s ex-president asks govt to properly highlight Kashmir issue

Former Azad Jammu and Kashmir president and prime minister Sardar Yaqoob Khan said on Monday the government should highlight the issue of the Indian Illegally Occupied Jammu and Kashmir (IIOJK) properly on international forums.

Addressing a press conference at a cricket ground, he said the silence of the United States, the United Kingdom, the European Union and other countries over the Indian atrocities against Kashmiris was worrisome.

The growing cruelties had compelled the Kashmiris to raise arms, he said and demanded that the special status of occupied Kashmir should be revived. Khan said the Kashmiris must be given the right to a plebiscite as per the resolutions of the United Nations Security Council.

He also showed his concerns over the Indian governments’ move to issue new domicile certificates in tens of thousands in the IIOJK, saying that the Modi government wanted to change the identity of the Muslim-majority region and turn the Kashmiris into a minority on their own soil.

“But the Kashmiris will not allow the Indian governments to succeed in its plan at every cost,” he said. “The indigenous resistance movement of the Kashmiris for their inalienable right to self-determination, as enshrined in the relevant UN Security Council resolutions, would only become stronger in the face of Indian state-terrorism.”

The Kashmiris had been suffering for decades and, despite the Indian atrocities, they were fighting for their right to self-determination, the AJK leader said. He said the hearts of Pakistanis beat with the hearts of the Kashmiris, and every year the Pakistanis celebrated Kashmir Day to show their commitment and love to the Kashmiri brethren.

He said they had full confidence in the Pakistani nation and army, and hoped that the Kashmir Issue would be resolved soon. Later, the trophy of a cricket tournament being arranged in connection with Kashmir Day was unveiled. Sardar Maqbool Zaman, Sardar Zulfiqar, Sardar Nazakat and others were also present on the occasion.
